1. Purpose of This System
AccessIEP is a secure, web-based platform designed to support special education teams in managing student behavioral data, Individualized Education Program (IEP) goals, and Behavior Intervention Plans (BIPs). This system contains personally identifiable information (PII) about students with disabilities, which is protected under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. Β§ 1232g, and its implementing regulations at 34 CFR Part 99.
2. Your Legal Responsibility Under FERPA
By accessing this system, you acknowledge and agree that:
You are an authorized school official or designated staff member with a legitimate educational interest in the student records contained in this system.
You will access only the student records necessary to perform your assigned professional duties.
You will not disclose, share, copy, photograph, screenshot, or transmit any student record or personally identifiable information to any unauthorized individual, including via text message, email, social media, or any other digital or physical means.
You understand that unauthorized disclosure of student records is a violation of federal law.
You will immediately report any suspected unauthorized access, data breach, or accidental disclosure to your building administrator and district technology coordinator.
3. Authorized Use Only
This system is provided exclusively for use by authorized personnel of the school district or educational institution that has contracted with AccessIEP. Your access credentials are personal and non-transferable. You must:
Never share your username or password with any other person.
Log out completely after each session, especially on shared or public devices.
Never access student records from unsecured public networks without explicit authorization from your district.
Never leave this application open and unattended on any device.
4. Device and Session Monitoring
For security and compliance purposes, AccessIEP automatically collects and logs the following information each time you log in:
IP address
Browser type and version
Operating system and device type
Screen resolution
Date and time of access
Pages and student records accessed
This information is retained for a minimum of one year in accordance with FERPA audit requirements and may be reviewed by authorized administrators in the event of a compliance investigation.
5. Student Data Handling
Student records within AccessIEP β including behavioral incident data, IEP goals, BIP plans, progress monitoring data, and any uploaded documents β are considered education records under FERPA. You agree that:
Student data will be used solely for educational and support purposes.
You will not retain copies of student data beyond what is necessary for your immediate professional duties.
Upon separation from employment, your access will be revoked and you will retain no right to access student records.
6. No Expectation of Privacy
You have no expectation of privacy when using this system. All activity within AccessIEP is subject to monitoring and logging by authorized administrators for compliance and security purposes.

You have read and understood this disclaimer in its entirety.
You agree to comply with all provisions stated above.
You understand your legal obligations under FERPA and accept personal responsibility for your use of this system.
You consent to the collection of device and session information as described in Section 4.
This acknowledgement is logged with your name, employee credentials, IP address, device information, and timestamp, and constitutes a legally binding record of your agreement.
